LD 11 Resolution – Overturn EO 2020-18

The following resolution was presented to the LD 11 GOP body on 4/30/2020. In a 60-0 vote, the resolution was adopted.


SUBJECT:  Call for the Arizona Legislature to overturn Governor Doug Ducey’s Executive Order 2020-18, “Stay-at-Home” order.

WHEREAS, the duly elected or appointed Precinct Committeemen of Legislative District 11 took a solemn oath to support the Constitution of the United States and the Constitution and laws of the State of Arizona to the best of their abilities and

WHEREAS, men are not angels, therefore societies have established governments to protect the rights of individuals and

WHEREAS, the governments of these United States are to function and operate only by and with the continued consent of the governed and

WHEREAS, certain of our rights such as life, liberty and pursuit of happiness are endowed by our Creator and NOT bestowed by any government body or official and

WHEREAS, we have collectively stood by and watched our rights and liberties squashed by unbridled power exerted in the name of public health and

WHEREAS, we witnessed Governor Ducey yesterday threaten any business owner with fines of $2,500 and 30 days imprisonment if they dared open their business ahead of his arbitrary schedule and

WHEREAS, all citizens have a right to provide for themselves and their families and

WHEREAS, COVID-19 poses little or no risk to the general population and only to a narrow spectrum, which has been clearly defined, of all citizens of the State of Arizona and

WHEREAS, the annual influenza outbreaks pose a far greater threat and danger and

WHEREAS, in five short weeks we have seen our great nation become a police state wherein fathers are arrested for playing with their children in parks, wherein lone joggers on beaches have been chased by police, wherein worshipers have been ticketed for sitting in church parking lots listening to sermons and the rights to assemble and associate with whom we choose have been abridged, wherein citizens have been requested to report on each other to authorities and

WHEREAS, we have frankly had enough, we now rise and declare

WHEREAS, the power of the State Executive is constrained strictly when interfering with civil rights and

WHEREAS, the Legislature of the State of Arizona has the authority to constrain the State Executive, therefore, be it

RESOLVED, that they exercise said power and overturn Executive Order 2020-18 forthwith.

    Reopen Arizona. We have been lied to about this Illness with false facts and statistics. None of this adds up to the draconian measures that have been imposed upon us by the State of Arizona and in direct violation of our Constitutional Rights!! We have a right to earn a living and have a free market economy! Reopen Arizona for business! Save our small businesses and economy from sure ruin and disaster!!

    Right on. I want to see a review of the need and effectiveness of the 6 foot social distancing. I understand it was established for coughing and sneezing. Is this 6 foot still needed if there is no coughing or sneezing? Is it needed if you are wearing masks?
    I would like to see some real science and testing to review this rule.
